Important points
Animals from the Grading and Black Factor (at least 75%) registers will be eligible for entry in unled classes in 2008.
New requirements for 2008 entries
All bulls will be required to have DNA results on file with the Society before close of entries.
All joining Sires and sires of calves at foot must be DNA tested before the close of entries

Substitutions
In the event of a nominated entry being unable to be offered at the National, a substitution will be permitted if a completed substitution form has been submitted with initial entries. Animals nominated in the led classes can be transferred to unled classes. In the event of a substitution/transfer being required, these must be notified to the Committee by 20th March 2008. Grading and Black Factor animals are not permitted to enter led classes.

Inspections
-Animals are required to be on site no later than 8am on day of inspections and there will be an 11pm curfew in place for 2008 for those animals arriving Tuesday evening
- Inspections for breed standard of excellence and measurements. The scrotal circumference and soundness inspection will be conducted at the sale inspection
- Animals that fail to meet inspection criteria may be re-inspected at the discretion of the inspector.
The National Show and Sale Committee reserves the right to reject any entries at their absolute discretion.
- Pregnancy diagnosis on-farm is required for females over 24 months at 24th April 2008
- Semen testing of bulls is available at Wodonga on Tuesday 22nd April. This must be pre booked on the entry form.(Cost$20.00 per Bull)
- On-farm inspections by an AACV veterinarian are recommended.
- The decision of the National Show and Sale Chairman will be final and no discussion will be entered into
.

Johne's Disease requirements.
The Committee has again decided to make the 2008 National available only to vendors with a minimum of:
1. Beef only
2. Protected zone status;
3. MN1, 2 & 3 from control or residual zone status;
Random drug testing will be carried out.



CONDITIONS OF ENTRY
The National Show and Sale is Society sponsored. It is the responsibility of members
entering cattle to understand the Conditions and be aware of implications arising from them.
In addition to the National Sale Conditions, the following extra Conditions also apply.
Special attention should be given to them. The lodging of an entry shall denote that the
Vendor (Nominator) accepts the Conditions and undertakes to comply with them.
All animals must be recorded with the Murray Grey Beef Cattle Society Limited and all
Vendors must be a full financial or junior member at the close of entries.
To be eligible for led classes animals must be REGISTERED as Purebred (87.5%) with the MGBCS. Calves at foot and joining sires must be at least 75%)
To be eligible for unled classes, animals can be registered as either Purebred (87.5%), Grading or Black Factor. Grading and Black Factor animals must be at least 75%. Calves at foot and joining sires must be at least 75%
All animals will be sold with physical possession being given to the purchaser
Together with a minimum of three-quarter share ownership including semen rights.

1. ANIMAL ELIGIBILITY
Led Bulls
Minimum age 16 months & 0 days, maximum 40 months & 0 days as at 24th April ‘08
Unled Bulls
Minimum age 16 months & 0 days, maximum 40 months & 0 days as at 24th April ‘08
Led Females*
Minimum age 12 months & 0 days, maximum10 years & 0 days as at 24th April ‘08
Unled Females*
Minimum age 12 months & 0 days, maximum10 years & 0 days as at 24th April ‘08

*Please note: Females over 24 months of age as at 24th April ‘08, shall be PTIC or
have a calf at foot. Females over 36 months of age shall be a minimum of 6 months PTIC or have a calf at foot. No females shall be sold with the product of more than one gestation at foot. Maximum age of calf at foot to be 9 months as at 24th April ‘08.

Led and Unled Animals.

Bulls and females are to be entered into one category only, ie Led bull/female or Unled
Bull / female In the event of a nominated entry being unable to be offered at the National, a substitution will be permitted if a completed substitution form has been submitted with initial entries. Animals nominated in the led classes can be transferred to unled classes. In the event of a substitution/transfer being required, these must be notified to the Committee by 20th March 2008.
Grading and Black Factor animals are not permitted to enter led classes
No other substitutions will be permitted and there will be no refund of fees after the close of entries.
All animals are subject to the same Inspection
criteria.
- Unled Animals must not be haltered on sale day.
- All led bulls MUST have nose rings.
- All led females MUST have nose rings or nose grips.
- All led animals must have neck straps.
- If neck straps are not left on animals after the sale a fee will be charged.
- All stock MUST be in the charge of the exhibitor or his/her representative at all times.
- All led cattle must be in shed by 1.00pm Wednesday (not in outside yards unless being washed or walked)

Scrotal circumference
Bulls shall have a scrotal circumference measurement of not less than 34cms.

Teeth/Age
Teeth will be checked.
Less than 18 months milk teeth.
18 to 24 months - no more than two teeth.
24 to 30 months - no more than four teeth.
Details provided on the animal’s AACV certificate will also be checked.

Sale of Share Ownership in Animals
All animals will be sold with a full physical possession.
A maximum of a one-quarter share can be retained in any animal but with no further call
on that animal.
Also, the Vendor is to declare if semen/embryos have been collected and his/her intention regarding the retained share, ie. use in own herd, or market licensed semen, etc.
Details of conditions being applied by a Vendor to a Lot must be specified on the Entry Form so that the information is published in the sale catalogue.
All animals must be active with MGBCS at the time of entry

2. GENETIC LOTS
This section comprises of 3 categories:
a) Frozen Embryos - A package of 2 or 4 existing frozen A Grade embryos from the same joining, with a guarantee of 50% pregnancy’s, provided the purchaser uses a recognized technician to store & implant eggs. Embryos will need to be implanted within 5 years from date of sale for guarantee to take effect.
The guarantee is to be backed-up with veterinary - technical documentation.
b) Live ET calves - (1 month to under 9 months of age, not to compete in show section).
c) Semen Lots - Minimum package of 10 straws of semen. To be collected by a licensed technician.
d) NB If members enter 2 embryo lots they can enter 1 semen lot at no charge.

3. RESERVE & FLOOR PRICE
The Committee reserves the right to set floor prices for each class of animal included in the sale.
Vendors have the right to set a reserve price on each and every animal included in the sale

4. ANIMAL HEALTH
a) Mannosidosis Requirements:
All entries (male and female) must be certified free of Mannosidosis either by test or by inheritance, and the results must be recorded with the Society.
EXPLANATORY NOTES AND SPECIAL CONDITIONS APPLYING TO THE NOMINATION OF GENETIC LOTS
The Purchaser, upon taking delivery, is to be responsible for insurance covering genetic
lots UNLESS a private contract is negotiated directly between vendor and purchaser to
incorporate different arrangements & guarantees etc. The Society is to be notified in
writing of the variation/s.
Frozen Embryo lots are to comprise of 2 or 4 A Grade standard embryos and certified as
such by the technician/veterinarian.
Vendors may display the donor parents and directly related cattle at the Showgrounds.
All such animals, including the recipients, must meet JD requirements as specified.
Application forms can be obtained from the Committee
All E.T. Genetic Sale Lots are subject to the Conditions of Entry and the Conditions of
National Sale.
The Society recognises that the technical or complex nature of some "genetic" entries
may mean that the Conditions of National Sale are deficient in dealing with unexpected situations which may arise.
Notwithstanding such circumstances, entries will only be accepted on the basis and
understanding that the Society has jurisdiction over the offering and any guarantees,
warranties and purchaser claims associated with the Lot/s.
Any nomination (entry) must be refused by the Committee unless it is accompanied by a Vendor guarantee of at least 50% resulting pregnancy.
b) JD Requirements:
All cattle offered must originate from herds with a minimum herd health status of:
- Beef only status
- Protected Zone status;
- MN1 from control zone or residual zone status;
Johne's declarations/certificates must be in the hands of the Committee by Thursday, 31st January 2008 with close of entries.
It is recommended that members participating in the National Johne's Disease Market
Assurance Program for Cattle, check on both the eligibility of the entry of their animals and
the return of animals from the National Sale venue, with the appropriate authorities.
Where crossing papers are required for entry of cattle from outside Victoria, they must be produced upon arrival at the Wodonga Showgrounds and handed to the Agents.
c) Herd Health Status Form
The Herd Health Status form will be forwarded by post or fax to Vendors on receipt of their
entry and must be received by the Committee Office by 20th March 2008. This is to be
completed by the Vendor and appropriate Government Officer.

5. PREGNANCY TEST CERTIFICATES
Pregnancy Test results must be in the hands of the Committee by no later than 20th March 2008 (preferably posted with health certificates).

6. CALVES AT FOOT
All calves at foot must be tattooed by the Vendor, and REGISTERED BY VENDOR
Calves at foot must accompany their dam at the time of Inspection on Wednesday, April 23rd 2008.

7. TATTOOS
All entries shall be inspected for tattoos. Entries with no, or illegible tattoos will be ineligible for show or sale. NO EXCEPTIONS WILL BE MADE.

8. INSPECTION AND MEASURING OF FEMALES
All females and calves at foot shall be inspected for breed standard of excellence, structure and measured for hip height on Wednesday, April 23rd at Wodonga ExhibitionCentre.
Recommended but optional that females are minimum 4 frame score

9. INSPECTION, WEIGHING, MEASURING AND SCANNING OF BULLS
All bulls shall be inspected for breed standard of excellence and structure, weighed, measured for hip height & scrotal size, scanned for fat depth and eye muscle area on Wednesday, April 23rd at the Wodonga Exhibition Centre.
Recommended but optional that bulls are minimum 5 frame score
This data plus their age shall be displayed in the supplementary catalogue

10. MURRAY GREY GROUP BREEDPLAN EBVS
Group BREEDPLAN EBVs are inserted automatically in the sale catalogue if available, but they are not a requirement for entry

11. TRANSFER OF OWNERSHIP
Signed transfer certificates must accompany entries. NO SIGNED CERTIFICATES - NO ACCEPTED ENTRY

12. ENTRY FORM
The accompanying "Entry Form" must be completed, signed by the vendors and returned to
the Committee Office by Thursday 31st January 2008, together with application fees and the Transfer of Ownership certificates.

13. SHOW SECTION - BULLS & FEMALES.
All entries shall be available for judging. All first prize winners shall be available for
Championship Awards. Only animals from led classes will be eligible for Grand Champion
Male or Female.

15. ORDER OF SALE

Order of Genetic lots will be decided once entries close. Also sale order may be
changed after assesment of entries.

16. DRUG TESTING
Vendors may be required to submit an entry to a random drug test.
Testing to be conducted by a Registered Veterinary Surgeon.

17. COMMISSION
The total commission charged by the Selling Agents on Lots sold is 9%, comprising 6% Agent's Commission, 2% Rebate Levy and 1% Society Sponsorship Levy.

liaise closely with their Agents and seek inspection of their entry or entries on property prior to the closing date for entries.

19. OPTIONAL VACCINATION HISTORY
Please indicate if your animals have been vaccinated for any of the following: leptospirosis,
5 in 1, vibriosis, 3-day sickness or pesti virus

20. OPTIONAL BULL EXAMINATION CERTIFICATE
It is an option for Vendors, on their own initiative, to supply a Bull Examination Certificate as
approved by the Australian Association of Cattle Veterinarians.

Cattle donated for Auction, with proceeds to benefit MGY, will be eligible
for the show & sale.

CONDITIONS OF SALE
The 2008 National Murray Grey Show and Sale will be conducted under the
conditions laid down by the Murray Grey Beef Cattle Society Ltd.

1. GENERAL CONDITIONS
1.1 Cattle Eligible for Entry - Led animals must be recorded as Purebred 87.5% (Calves at foot and joining sires not less than75%) Unled animals can be registered as Purebred 87.5%, Grading or Black Factor. Grading or Black Factor animals must be at least 75%. Calves at foot and joining sires must be at least 75%
1.1.1 Male cattle no less than 16 months & 0 days of age, maximum 40 months & 0 days as at 24th April ‘08.
1.1.2 Females cattle minimum age 12 months & 0 days, maximum10 years & 0 days as at 24th April ‘08
1.1.3 Calves at foot shall be less than nine months & 0 days of age as at 24th April, ‘08
and shall be the result of a single sire mating.
1.1.4 Special conditions of sale are:
1.1.4.1 Minimum scrotal circumference
1.1.4.2 Fat depth measurements, as per back fat scan over the rib-eye, P8 site and EMA
(male cattle).
1.1.4.3 Inspection for scrotal measurement and soundness
1.2 Conduct of Sale
1.2.1 The auctioneers conducting the sale shall be approved by the Committee. However, the Committee does not accept any responsibility for any loss or damage occasioned through the actions or omissions of the auctioneer.
1.2.2 Reserve and Floor Price
The Committee reserves the right to set floor prices for each class of animal included in the sale.
Vendors have the right to set a reserve price on each and every animal included in the sale.
1.2.3 All cattle sold are at the purchaser's risk on the fall of the hammer.
1.3 Inspection of Cattle
1.3.1 The vendor shall ascertain from the Committee the time and place for inspection of cattle entered
Inspections Include frame score, dentition, weighing, scanning and tattoo verification.
1.4 Health Requirements
1.4.1 All cattle offered shall comply with the health requirements of the State or area in
which the sale is being conducted.
1.4.2 All cattle offered must originate from herds with a minimum herd health status of
- Beef only
- Protected Zone status or
- MN1,2 &3 from Control Zone or Residual Zone status
1.4.3 Cattle sold for interstate delivery shall comply with the health requirements of that state.
1.4.4 All cattle offered shall be free of mannosidosis.
1.5 Commission
Agents shall charge the rates prescribed by the Stud Stock Salesman's Association, or the
equivalent body, in the particular state in which the sale is being conducted, plus 1%payable to the Committee and 2% commission rebate.
1.6 Procedure for Claims
1.6.1 Claims will be received by the Committee in respect of guarantees of fertility, misrepresentation of cattle sold and costs incurred under clause 1.7(d) (i) & (ii) and 3.10.
1.6.2 All claims shall be in writing and must be lodged with the Society by the person making
the claim within the stated time limit for that claim.
1.6.3 Immediately upon receipt of any claim the Society shall notify the other party of all
details in respect of that claim, and shall allow that other party a reasonable time to make
any submissions in relation to the claim.
1.6.3A The Society may direct the parties to submit the dispute to mediation and the parties must comply with such direction and participate in good faith in a genuine attempt to compromise the dispute
1.6.4 If, in the opinion of the Society, either party to a claim fails to co-operate satisfactorily in the proper processing of the claim, the Society may in its absolute discretion, make a decision in respect of that claim.
Save and except for the responsibilities outlined in clause 5, the Society shall not bear any liability in respect of any representations as to the quality, characteristics or suitability for purpose of any animals offered for sale or sold at the National Show and Sale.
1.6.5 The Society's decision in respect of all claims shall be final and binding upon all parties involved.
1.6A No Litigation
1.6A.1 By participating in the sale, the Vendor and the Purchaser agree that any Claim must be made in accordance with these Conditions of Sale and not otherwise.
1.6A.2 To the maximum extent possible in law, the Vendor and the Purchaser waive all rights to pursue Claims by litigation or by any other means other than in accordance with these conditions of sale.
1.6A.3 To the maximum extent possible in law, the Vendor and the Purchaser release each other from all causes of action which they may now or at any time in the future have against each other (whether or not known to the parties at the time of the sale) arising out of or in connection with the sale and purchases of cattle pursuant to these conditions of sale, other than Claims made in accordance with these conditions of sale.
1.6A.4 This clause 1.6A extends to all causes of action, whether arising in contract, tort, equity or by statute, including without limitation the Trade Practices Act 1974 (Cth) and equivalent State and Territory fair trading legislation.
1.6A.5 This clause does not extend to prevent a Vendor or a Purchaser from enforcing a decision of the Society by litigation
1.7 Claims under Fertility Guarantees
(a) Time limit for claims
(i) Bulls.
Claims must be received by the Society within six months from the date of the sale or prior
to the animals entering a quarantine area other than on the vendor's property.
(ii) Females.
Claims must be received by the Society within six months from the date of the sale or
before the animal reaches the age of 30 months whichever is the later date but in any
event before the animal enters a quarantine area other than on the vendor's property.
(b) Claims must be accompanied by a veterinary certificate, which shall clearly identify the
basis of the claim.
(c) Infertility resulting from disease or injury occurring after the sale of the animal shall not
be covered by this guarantee.
(d) Rights of the Vendor
(i) To obtain at his expense a second opinion from a veterinary surgeon acceptable to both
parties and failing agreement nominated by the Society.
(ii) To have the animal placed on a property nominated by him for further assessment of fertility for a period not exceeding three months.
In the event of the animal proven fertile within that period the costs incurred shall be borne
by the purchaser. In the event of the animal not being proven fertile within that period the
cost incurred shall be borne by the vendor.
(e) All claims are null and void if the animal/s enter/s an area which is under quarantine.
1.8 Claims relating to misrepresentation.
Such claims must be lodged in writing with the Society within 30 days from the date of sale.
1.9 Claims relating to Costs Incurred.
Claims in respect of costs incurred under clauses 1.7(d) (i) & (ii) and 3.10 must be
lodged in writing with the Society within 30 days of settlement for the costs being requested.
1.10 Limitation of Liability of a Vendor
Except for cost defined elsewhere in these conditions, the liability of a vendor in respect
of claims relating to fertility or misrepresentation shall not exceed the purchase price of
the animal/s.
1.11 Refunds
In the event of a claim being substantiated and the purchase price being refunded, the
animal/s shall automatically become the property of the vendor, and be returned to
him or disposed of according to his instructions, at his expense.

2. AGENT(S)’ RESPONSIBILITIES
The Agent(s) shall be responsible for:
2.1 Providing adequate and suitable staff and facilities for the proper reception, handling,
presentation, sale and delivery of cattle.
2.2 Ensuring that all animals catalogued but not offered for sale are removed from the
area of the sale.
2.3 Procuring transportation for cattle sold when required to do so by the purchaser.
2.4 Settling with vendors within 30 days of the date of sale. In the event of the sale being
conditional on the satisfactory completion of further necessary tests for interstate delivery,
settlement shall be made by paying the appropriate sum of money into an interest bearing
trust account to the credit of the vendor.
2.5 Paying to the Society 1% of the total value of the sale.

3. VENDORS' RESPONSIBILITIES
Guarantee and Indemnity:
By submitting an animal(s) for sale at a sponsored sale, the vendor guarantees the soundness, condition, presentation, breed characteristics and growth and age of the animal
and that it meets the health requirements laid down by the Society in its Regulations and
agrees to indemnify the Society against any loss or damage whatsoever occasioned due
to breach of any of the above matters. In respect of his own entries a vendor shall be
responsible for:
3.1 Ensuring that all animals offered for sale have been:
3.1.1 Assessed as suitable by the authorized inspectors.
3.2 The accuracy and legibility of tattoos of all cattle entered including calves at foot.
3.3 The accuracy of information supplied on entry forms.
3.4 Obtaining and lodging with the Committee all necessary health certificates and results of
pregnancy tests prior to the cattle being offered for sale.
3.5 Presenting for inspection all cattle intended for sale at the time and place stipulated.
3.6 Ensuring that no animal is offered for sale unless:
3.6.1 It has been assessed by a veterinarian.
3.6.2 The Committee have in their possession at the time of the sale the required health documentation for that animal and where appropriate a certificate of the result of a pregnancy test.
3.7 Ensuring that all animals catalogued but not offered for sale are removed from the area
of the sale.
3.8 The payment of fees for cataloguing and advertising animal(s) shown in the catalogue
irrespective of whether an animal be subsequently withdrawn from or ineligible for sale.
3.9 The proper presentation of cattle in the sale ring.
3.10 The completion of additional tests necessary for interstate delivery and the care of the
cattle on behalf of and at the expense of the purchaser during such time as the cattle are held on the vendor's property following the sale.
3.11 Returning the purchase price less commission and costs certified by the Society to
the purchaser in the event that an animal fails subsequent tests.
3.12 Guarantee of fertility
3.12.1 Bulls. Save and except for bull calves at foot all bulls are guaranteed to be FERTILE
AND CAPABLE OF NATURAL SERVICE and to so prove within 6 months of the date of sale.
3.12.2 Females. Save and except for female calves at foot, all females are guaranteed to
be in calf or to go into calf within six months. A positive pregnancy test certified by a qualified Veterinary Surgeon shall be sufficient evidence that the animal is in calf. Guarantees of fertility are subject to the conditions stated in section 1.7
to 1.8 both inclusive.
3.13 Ensuring that the entry complies with Regulation 16 of the Society's Regulations relating to the use of drugs. Vendors may be required to submit an entry to a test conducted
by a registered Veterinary Surgeon at the expense of the Society to determine compliance
with Regulation 16. In the event an entry is found to contravene Regulation 16, the owner
of such entry shall be liable to pay the costs of the test and further suffer the sanctions set out in Regulation 16 and render any sale of the animal void.
3.14 Returning the purchase price, less certified costs if applicable, to the purchaser in the event of a claim for fertility or misrepresentation being upheld by the Society.

4. PURCHASERS RESPONSIBILITIES
In respect of cattle purchased by him or on his behalf a purchaser shall be responsible for:
4.1 Observing the conditions under which a claim may be made.
4.2 Paying to the vendor any costs to the level certified as reasonable by the Society and
incurred by him under clauses 1.7(d)(i) & (ii) and 3.10 of these conditions.

5. SOCIETY RESPONSIBILITIES
The Society shall be responsible for:
5.1 Verifying that the following details are correct, according to records held by the Society, for the animal bearing the stated tattoo identification - name, date of birth, registration status, sex, colour, pedigree, ownership and, except for calves at foot, Herdbook number.
5.2 The processing of claims lodged with the Society.
5.3 Certifying when requested the reasonability of costs incurred by a vendor under clauses 1.7(d) (i) & (ii) and 3.10.
5.4 The Society shall not bear any liability associated with the inspection by an inspector of the animals. Any loss or damage occasioned by the inspection shall be borne by the vendor.
5.5 Forwarding to the purchaser on request all relevant health and/or pregnancy certificates prior to or on delivery of the animal(s).
